Terms and Conditions

PLEASE READ THESE TERMS OF USE ("TERMS") CAREFULLY BEFORE USING THIS WEBSITE ("SITE"). USING THIS SITE INDICATES THAT YOU HAVE READ AND ACCEPT THESE TERMS. IF YOU DO NOT ACCEPT THESE TERMS, YOU ARE NOT AUTHORIZED TO USE THIS SITE. THESE TERMS GOVERN YOUR USE OF THE SITE, ANY SERVICE AND CONTENT (SUCH AS TEXT, DATA, INFORMATION, SOFTWARE, GRAPHICS, OR PHOTOGRAPHS) THAT AUSCAUSE AND ITS SUBSIDIARIES (COLLECTIVELY, "AusCause") MAY MAKE AVAILABLE THROUGH THE SITE (COLLECTIVELY, "MATERIALS") AND ANY SERVICES THAT AUSCAUSE MAY PROVIDE THROUGH THE SITE (COLLECTIVELY, "SERVICES"). THE SITE, MATERIALS, AND DONATION SERVICES ARE REFERRED TO IN THESE TERMS COLLECTIVELY AS THE "AUSCAUSE WEBSITE."
1. TERMS

Welcome to the world of http://www.AusCause.com.au owned and operated by registered Australian entity AusCause (hereinafter also referred as to the "Website", "Site", "We", "Us"). AusCause.com.au is the first ever concept introduced in and operated from Australia which offers people a platform to donate money to their favorite cause for free by simply searching and purchasing goods and/or services from the malls listed on the AusCause Website. To use the services of the AusCause website You (hereinafter also referred as to the "Member" or "User" defined below) have to register with the website and create a member account.

2. DEFINITIONS

"User"

"User" represents any person who visits the website and uses its features and services without registering as a Member

"Member" or "Registered Member"

"Member" or "Registered Member’ means any Visitor who follows the registration procedure of the website and creates a member account.

"Transactions"

For the purposes of these Terms and Conditions, ‘Transactions’ shall include all services that are being offered by the AusCause website, irrespective of whether they are free or paid, including orders with a third party. Furthermore, it shall include orders, signing up for services or membership even without making any payment for such goods, services or membership.

"You" and "Your" refer to the person who use the website and accepts and agrees to the terms and conditions of this Agreement.

3. IMPORTANT INFORMATION

Pursuant to Section 178BA of the Crimes Act (NSW) 1900, AusCause forbids you to create more than one account with the AusCause website and restricts you to join on behalf of a family member or friend. If AusCause finds you infringing this section, it will immediately cancel all your accounts and you will lose all of your earned commissions. You should not allow anyone else to sign in to your account.

4. REGISTRATION PROCEDURE

To avail the service of the website, you are first required to register with the website under a Member Account and for this you must be over eighteen years of age;

4.1. If You are between 14 and 17 years of age, you must have a parent’s or guardian’s permission to join;

4.2. Individuals less than 14 years of age cannot register with AusCause.com.au;

4.3. All of the information that you provide must be true and accurate and you should inform us at the earliest possible for any change in details.;

4.4. When you register with us, you agree to allow us to send you communication regarding any offers and updates etc from time to time. .

4.5. While registering with the AusCause website you need to select out of the following provided options:

             4.5.1. Donate the earned commissions to a selected cause anonymously.

             4.5.2. Donate the earned commissions to a selected cause on your name.

             4.5.3. Request your earned commission for your use instead of donating anything.

4.6. You need to simply select the cause or charity for donating your earned commission and AusCase will make donations when your earned commission reach threshold value, i.e. AUD 25. You can change the selected charity or cause from your member account.

5. CLICK TO AGREE AGREEMENT

By using the AusCause Site and clicking the "I AGREE" checkbox on the Registration form, you acknowledge your acceptance of the Terms and Conditions of this Agreement.

By affirmatively clicking the "I AGREE" checkbox, you are simultaneously


· registering as a "Member" of AusCause Website

· making certain representations and warranties, as further described in terms below, and

· agreeing to the Terms and Conditions of this Agreement.


If you do not accept this Agreement, You are not authorized to use the Website. If you have any questions about this Agreement, kindly inform us at support@auscause.com.au

6. REGISTERED EMAIL ADDRESS

6.1. AusCause requires to provide a valid email address (referred to as the ‘registered email address’) which we can keep for our records and send any required communication. You can start using the website as soon after registration process is complete.

6.2. The email address you provide when you register must be an active email address in regular use by you.

6.3. Your registered email address must not be the registered email address of any other member of the Service.

7. ACCURACY, HONESTY AND INTEGRITY

7.1. At all times in your dealings with AusCause and its partners and suppliers you must act with integrity and honesty.

8. UNLAWFUL USE OF THE AUSCAUSE WEBSITE

8.1. You must not use the AusCause website for any unlawful purpose.

8.2. You must not post or introduce software on the Site that

          (i) is designed and intended to disrupt, disable, harm or otherwise impede in any manner, including aesthetic disruptions or distortions, the operation of this Site or any other software, firmware, hardware, computer system or network (sometimes referred to as "viruses" or "worms");

          (ii) would disable or impair this Site or any other software, firmware, hardware, computer systems or networks in any way where such disablement or impairment is caused by the elapsing of a period of time, exceeding an authorized number of copies, advancement to a particular date or other numeral (sometimes referred to as "time bombs," "time locks" or "drop dead" devices);

          (iii) would permit you or any other person to access this Site or any other software, firmware, hardware, computer systems or networks to cause such disablement or impairment or transmit information (sometimes referred to as "traps," "access codes," or "trap door" devices, or "spyware"); or

          (iv) which may contain any other similar harmful, malicious or hidden procedures, routines or mechanisms which would cause such programs to cease functioning or to damage or corrupt data, storage media, programs, equipment or communications or otherwise interfere with operations.

8.3. On an event of your breach of any of the conditions above, your membership will be cancelled and you may be prosecuted for damages or expenses arising directly or indirectly out of your actions.

9. AUSCAUSE SERVICES TERMS AND CONDITIONS

AusCause.com.au facilitates Members with a sophisticated web based platform to search and list causes/charities; and search for shopping malls to purchase goods. AusCause represents the Member of the AusCause service, not advertisers, sponsors, or causes. An individual who signs up with AusCause Site becomes a Member and enters willingly into this agreement. Members list causes for their own use, and for the use of other members. 

Monies are earned by members and are credited to members´ accounts, and then disbursed from their accounts to their selected cause(s) when it reaches the minimum thresh hold i.e. AUD 25. Members also have the option to encash them for personal use. You can choose between cheque or paypal transfer method to request the earned commission. AusCause is providing a service to its members, not to causes. Any taxes on this are the responsibility of the member."

10. ONLINE SHOPPING AT MALLS LISTED ON AUSCAUSE

AusCause lists third party online malls to you for your convenience, offers and shopping, furthermore, it is to be noted that AusCause does not have any affiliation with any of the malls listed on the website. You acknowledge that we act as a referral agent only and are not responsible for the quality of goods and/or services you receive from any third party. In some instances, certain products, services, or offerings are expressly excluded from the offer of commission points. You should ensure that you fully understand any exclusions, terms, conditions, and requirements as displayed before proceeding with a transaction. AusCause website is only able to offer incentive to you for making a transaction at any third party listed in the online malls sections, if you make that transaction as an individual referred to the third party by us. The offer of commission is made on the basis that the third party pays AusCause a pre-determined payment for referring you to the third party. You acknowledge that we may elect not to credit you with commissions if the third party elects not to pay us commission for referring you.

11. CANCELLATION OF ORDER AND APPROVED COMMISSIONS

You hereby agree and understand that AusCause will not credit you with commissions, and may deduct already credited commissions, for a transaction you make at a third party online portal if you subsequently cancel the transaction or order, return the goods for refund or credit, or fail to pay for the order in full. We will reject your claims for commissions made by a fraudulent or deceptive manner, determined by AusCause at its discretion. If you are found to indulge in fraudulent means we may charge you penalty or cancel your membership.

12. COMMISSIONS EARNED

12.1 AusCause website keeps a membership account for you. Under a member account, you can check balance of all your earned commissions pursuant to purchases from the listed malls on the website. Following are the conditions you must satisfy in order to be eligible to earn commissions:

          12.1.1. the transaction must be initiated by using a link to the third party listed on the AusCause web site, and;


          12.1.2. during the time you use AusCause link and make the transaction, you must not use any other referral or tracking link for that third party mall, and;


          12.1.3. wherever asked and/or stated, you must complete any other required actions including answering any questions; and


          12.1.4. wherever asked and/or stated, you must comply with any other terms, conditions and requirements.

12.2. You understand and agree that AusCause website will distribute your earned commission to your selected charity or cause(s).

12.3. AusCause is not liable to you for payment of any commissions, until such time as your commission balance reaches the minimum threshold value, i.e. AUD 25.

12.4. You hereby expressly acknowledge and agree that your eligibility to redeem your commission is conditional upon your ongoing compliance with these Terms of Service. AusCause at its own discretion, may cancel your membership of the Service, cancel any right or interest that you may have in the reward points that you have accumulated, and cancel any outstanding redemption or payment of cash or prizes if at any time AusCause have evidence or reason to believe that you are not in compliance with these Terms of Service.

12.5. If you choose to cancel your AusCause membership account, all of your earned commissions are immediately and irreversibly forfeited. All outstanding and pending payments and bonuses are immediately cancelled.

13. PAYMENT METHODS

Monies are earned by members and are credited to members´ accounts, and then disbursed by AusCause on behalf of the member to their selected cause(s) when it reaches the minimum thresh hold i.e. AUD 25. Members also have the option to encash them for personal use. You can request your earned commissions either via cheque at your provided address or to your paypal account.

13.1. Cheque 
You are solely responsible in providing complete and proper address where cheque needs to be delivered. AusCause takes no responsibility for mishandling, misappropriation or wrong delivery of the cheque. At an instance of double handling of your cheque by AusCause, an AUD $15 fee will be levied against your account.


13.2. PayPal
You are solely responsible for providing correct and active paypal account where earned commissions can be sent by AusCause. You hereby agree that AusCause is not responsible in sending payments to a wrong or inactive paypal account.

14. MEMBERS’ CAUSES / CHARITIES



14.1. List a Cause

AusCause members are eligible to list any cause/charity if it is located and operated out of Australia thereupon engaging in legal activities that benefit the public good or particular cause. Auscause.com.au does NOT require your cause to be a ‘not for profit’ or otherwise tax-exempt. Whether your cause is large or small, it's welcome here.



14.2. Donate to a Cause

At the time of registration, you can choose any cause(s) listed on AusCause website. AusCause will make donations on your behalf when your earned commissions reach threshold value, i.e. AUD 25. You may either do it anonymously or by disclosing your identity. You can change the selected charity or cause from your member account. AusCause website does not represent any of the listed causes hence it is not authorized to issue receipts for your donations.

15. ACCEPTANCE AND CHANGES TO THESE TERMS OF USE

Please check these terms periodically for changes. These terms and conditions must be read in conjunction with any other applicable "terms and conditions", "privacy policy" and "disclaimer" governing the use of this web site.

16. REVOCATION OF MEMBERSHIP

Auscause.com.au reserves all rights for revocation/cancellation of membership with or without notice. AusCause.com.au state grounds for revocation of membership listed below:
          · Using AusCause.com.au services without signing in;
          · Dodging the AusCause.com.au terms and conditions agreement;
          · Using automated ways to create entries;
          · Creating user ID on fake name.;
          · Providing fake and fictious / unidentifiable information;
          · Sign Up multiple times;
          · Using for spreading hatred or violence or pornographic activities.
          · Breaching any of the term of this agreement

17. VOLUNTARY TERMINATION

You have an option to delete / cancel your account with AusCause for any or no reason with or without notice but your account information is stored in our server for security reasons.

18. TAX ABSTRACTION

AusCause.com.au is not qualified to provide tax deductibility for any donations to charity or cause. However, you can obtain your own professional tax or legal services to analyze whether the rebate provided by the merchant used by you for donation meets the structural qualifications of the NAT code, including if the donation is made to the Deductible Gift Recipient’s (DGRs).

19. BONUS PROVISION 

19.1 Your registration bonus is prepayments of any money donated to your cause providing the 
member has made a purchase within 45 days after the initial registration. 


19.2 Current registration bonus is $5 per member.


19.3 AusCause.com.au may provide bonuses in the future for your chosen cause. 


19.4 AusCause.com.au is allowed to vary the conditions.


19.5 AusCuse.com.au may provide promotional bonus from time to time.

20. FORFEITING OF BONUS

You hereby understand and agree that any Bonus amount earned pursuant to Section 19 Bonus Provision will be forfeited at the cancellation of membership as per under section 16 and 17 of this Agreement.

21. REFER A FRIEND

21.1. You expressly acknowledge that you are not permitted to have more than one membership of AusCause, and that you are not permitted to join AusCause on behalf of another individual. You acknowledge that having more than one membership or joining on behalf of another for the purposes of obtaining referral amount is considered by us to be deceptive and fraudulent behavior, and therefore if we have evidence or reason to believe that you have acted as such we may deduct referral amount from your account, or we may cancel your membership account or the referred membership account.


21.2. We reserve the right to deduct from your account any amount credited to you in relation to a referral if the referred account is cancelled by us or by the referred member within three months of the date of the referred member joining.


21.3. You must not make any misleading statements about AusCause, or misrepresent to the person you refer, the amount of rewards and benefits they may earn from their AusCause membership.


21.4. You must not display or post your referral link or any banner on any website that contains any unlawful, threatening, abusive, defamatory, obscene, vulgar, pornographic, profane or indecent information or material.

22. REPRESENTATIONS AND DISCLAIMER OF WARRANTIES

22.1 You agree that you are responsible for your own conduct and communications while using 
the Service and for any consequences thereof.


22.2 Your use of the Web Site will not violate any law or regulation of the Australia or governing 
local laws.


22.3 We represent and warrant that the services provided hereunder are provided "as is," without any warranties or conditions(expressed or implied, arising by statute or otherwise in law or from a course of dealing or usage or trade). We make no limitation representations or warranties, of any kind (either express or implied) including without the implied warranty of non-infringement, as to the quality, identity or reliability of any registered user or third party, or as to the accuracy of the information made on the web site by any registered use.


22.4 This website may contain links to Third Party Sites. AusCause neither endorses nor isaffiliated with any Third Party site and is not responsible for any content of any such site. Therefore verify the veracity of all information on your own before undertaking reliance and actioning thereupon. AusCause shall not be responsible nor liable for any consequential damages arising on account of your relying on the contents of such third party sites. 

23. INDEMNIFICATION

You are entirely responsible for any and all activities, which occur, under your user account. AusCause.com.au will not entertain any third party claims, liability, damages or any other cost arising from your use. You are also responsible for your violation of the Terms and Conditions of Use, or your infringement, or the infringement or use by any other user of your account, of any intellectual property or other right of any person or entity. You also agree to immediately notify us of any unauthorized use of your user account or any other breach of security known to you.

24. LIMITATIONS OF LIABILITY

Subject to the previous paragraph, neither AusCause.com.au nor its directors, partners, officers, agents or employees shall be responsible for any direct, indirect, incidental, special, consequential, exemplary or punitive damages, or any other damages whether arising under contract, warranty, or tort ( including negligence or strict liability) or any other theory of liability whatsoever (including without limitation, damages for loss of business or loss of profits), arising in contract, tort or otherwise from the use or inability to use this site.

25. INTELLECTUAL PROPERTY

You may not upload, embed, post, email, transmit or otherwise make available any material that infringes any copyright, patent, trademark, trade secret or other proprietary rights of any person or entity. AusCause.com.au has the right to terminate the membership of such infringers.

26. GOVERNING LAW

These Terms of Use are governed by, and is to be construed in accordance with, the laws of the State of Victoria, Australia. You agree that the courts of the State of Victoria, Australia have non-exclusive jurisdiction with respect to any matter arising from these Terms of Use or this website.
